So The ACLU Thinks A Prom is More Important Than The Civil Rights Of The...
Posted On 03/31/2010 19:13:17

So the battle continues. My appeal has been filed with the US Court of Appeals and a motion will be submitted to have my case placed on the emergency docket.

But I have some disturbing news. The ACLU. who was so quick to jump on the case of the girl in Mississippi who's prom was cancelled because she wanted to bring a same sex date tell me they can't help me. It seems that prom cacellation is more important than me and my family's well being. How do I tell my children that people think a prom is more important than you having a hot meal and roof over your head?

The ACLU states "We are limited to handling cases which have a statewide implication, those which affect the rights of a large group of people through reform of law or government practice, and those that present a significant constitutional issue."

WTF???? Last time I checked, the mentally disabled were a large group of people who are discriminated due to myths and stereotypes. How can the ACLU give priority to prom over the well being of so many people.

I'm asking everyone on here to please help me.

here's the email I rec'd from the ACLU:

We have received your request for assistance. Our Executive Director had received your phone call, but she does not handle requests. I am the intake representative here and handle all requests for assistance. However, we have determined that we are unable to help you at this time.  We are limited to handling cases which have a statewide implication, those which affect the rights of a large group of people through reform of law or government practice, and those that present a significant constitutional issue. Limited financial resources and limited attorney time prevent us from handling many of the requests we receive, including those where real injustices appear to have taken place.  Our decision, therefore, is no reflection of the merits of your claim, but an attempt to make a realistic judgment on how much we can do with our limited resource base. Please understand that most legal claims have a time limit.  Writing to ACLU-TN does not extend any time limits that may affect your specific claim.

Can Joey Bring Atttention To My Cause
Posted On 03/18/2010 13:51:20

I'm in a legal battle where my former company, The Bank of New York Mellon has bought into the myths and sterotypes that surround bipolar disorder. This has been going on over two years and it's hard for the little guy to battle an army of corporate lawyers.

I ask all of you out there to visit my web page www.bnymellon-lies.com and email me your comments. I'll post them.

Want to make a comment about my site right to the CEO: bob.kelly@bnymellon.com

You can read my story on the site and also see how a corporate power house lied and their attempt to cover the lies.

Legal Battle
Posted On 03/11/2010 12:34:58

In October of 2007 I was terminated from my job at Bank of New York - Mellon. I was terminated because I was deemded a threat. Why was I a threat?

  • During a period of mania I implusively posted a paradoy of a company motivation poster in my cubicle. I poked fun at the company's "Impact is Inspiration" poster by creating a smaller facimile of the test and replacing the empoyee picture with a picture of Charles Manson. I thought was funny at the time but in retrospect, no. I was asked to remove the poster and I did. Other employees had parodies of corportate culture (including using words like "shit"). This "triggered" an investigation of my internet access.
  • Being a former Marine, I checked MilitaryPhotos.net often. The site posts photos from offical sources all in one place. That is, you can see photos published by the Department of Defense, Department of the Navy, British MOD, etc... all in one place. The Bank of New York - Melllon falsely tries to claim that these are all pictures of assualt weapons. Such a statement is a total mischaracterization of the truth.
  • They deemed that since I looked at these photos I am a potential threat. Yea, I'm going to hijack a billion dollar aircraft carrier to strike at my employer (sarcasim). They used this so called threat as a reason to terminate me after 10 years of service.
  • This is where it gets good; I asked that the letter of discipline that I received for the parody poster be removed only two business days after I received it. The conduct was a direct result of the impulsivity that mania breeds. The poster had no function on my job performance and the ADA states that this is a valid reasonable accommodation.
  • The Bank of New York Mellon claims they were unaware of my illness until I request the reasonable accommodation. This is an outright lie. They knew well of my illness as far back as 2004.
  • Don Enfinger, that general manager of the facility that I worked at claimed that I defaced company property. When they found out that I had photos of this "so-called piece of property" (the original poster) time-stamped two weeks after my termination, in pristine condition did they finally back off that claim.
  • Did I look at guns? Yes I did, and so did  many of my coworkers.  Sites that were classified as fire arms were two-tenths of one percent of my internet access (based on the bank's records). That's 0.2%!!!! Why is this problem, other people looked at guns, hunting, etc.??? It's a problem because I'm bipolar. That right, BIPOLAR. so this puts a different standard on me than other people.
  • In fact, Don Enfinger states that the employee who reported my parody stated that I looked at "assault weapons" on the internet. The only problem for the Bank of New York - Mellon is that this employee signed an affidavit where he states that he never said anything about "assault weapons". This is just another lie from Don Enfinger and the Bank of New York.
  • Two employees signed statments that mangement referred to me (behind my back yet openly) as "Wacko" and "Crazy Rob". That's The Bank of New York - Mellon way to refer to people with psych disorders.

My time is limited right now so I'll add more to the blog as soon as I can. I want justice!!!

Stigma - Henry Miller Quote

Pride and the South
Posted On 08/25/2009 19:08:33

Growing up in New Jersey gives you a certain attitude. When I finally “came out” and told the world that I was bipolar, in the usually “Jersey way” I did it with humor and shock. I accepted who I was and knew that those that accepted me came to cherish “Crazy Rob” for his candor, frankness, and shock humor.

Only after you come out, can you identify who loves and accepts you for the individual you are. I always had a smart-ass answer or comment to make, and those that accepted me were never offended.

I relocated to Nashville four years ago and it’s a very different culture here. I found that there were some who were willing to understand my illness and thoroughly enjoy my friendship. Unfortunately I found that there were some that have preconceived notions about mental illness and to be blunt, they don’t like anyone they see as different.

I want to be graceful about this as possible so not to offend anyone. I see the challenges I face in the South as an outgrowth of morale conservatism and religious fundamentalism. It’s very had to be different here. Outside of my job, there’s one think I won’t do, and that is NOT be proud of the individual I am, and being bipolar is an important part of me.

To those that don’t accept me, I make sure I get a rise from them in the process. Since this is only my second entry I won’t go into the explicit shock details at this time. I can however, guarantee that many will really get a blast from my behavior.

On a closing note, NEVER be ashamed of your illness! To those who condemn, vilify, or trivialize you tell them where to go!!!

Rob

Bipolar And Happy!!!
Posted On 08/24/2009 13:37:57

Greeting everyone!!! I’m Rob, a new guy here. I found my way through the ABS News article. I was first diagnosed with bipolar disorder back in 1990. I tried to ignore it and almost ten years later my life was coming to a screeching halt.

I finally got wise, got clean, got on meds, and got monthly therapy with an awesome psychologist. I too came to embrace my disorder. I became very creative and artistic. I also accepted who I am and what I am.

I grew up in Jersey City and spent a lot of time in Hoboken in the 1980’s and 1990’s. Lived in Red Bank for 12 years before taking a job transfer to Tennessee (B-I-G mistake!!!!!) in 2005. I wound up getting fired from after 10 years with the same company. I was fortunate to find another job, be it at startup for quite a bit less money.

I lost my job over my disorder. Yeah, a company the sells itself on its diversity and it support for The Americans with Disabilities Act. After two years of getting jerked around my case is scheduled for court in January.

I plan on talking about my case in this blog. Every few days I publish the how’s, what’s and why’s corporate America doesn’t want to employ people with mental illness or psychiatric disorders.
